Types of Title Insurance Policies

Title insurance helps protect against financial losses resulting from covered defects in a property's title, including the legal costs of defending your ownership rights against covered claims.

There are TWO types of title insurance policies:

Owner's Policy

An Owner's Policy protects your ownership rights against covered title claims for as long as you or your heirs have an interest in the property. If a covered claim were to be made against your property, your title policy would cover the costs associated with defending your ownership rights.

Loan Policy

Typically required by your mortgage lender, this policy protects the lender's financial interest in the property. Unlike an Owner's Policy, it does not protect your ownership rights.

Common Title Issues

Most title issues are identified and resolved prior to closing during the thorough title search, examination, and curative work process, but claims still happen. Here are some of the most common title issues:

  • Unpaid mortgages and liens
  • Ownership disputes or undisclosed heirs
  • Errors in public records
  • Seller impersonation fraud and forged documents
  • Survey and boundary disputes
  • Deed not properly recorded
  • Undiscovered easements or use restrictions
  • Errors in tax records
  • Unpaid estate, inheritance, or income tax liens
    Errors in legal description
  • Undisclosed notice of pending lawsuit
  • Covenant violations
